Helpful instructions and suggestions on the electronic submission process

Lately there have been concerns expressed by both subscribers and staff as to the registration process associated with electronic submission, and the relevant directives that govern that part of the registration process both electronically and in hard copy format for documents that cannot be submitted electronically.

To ensure consistency of process and also to comply with legislative and regulatory requirements under the Land Titles Act and the Registry Act , you will find enclosed communiqu�s that outline the registration process for

  • Multiples variations of names of individual transferors on the electronic transfer - which also applies to mortgages and collateral mortgages in appropriate circumstances, by also referencing the name variations in the Schedule "D"
  • Signature lines that must and must not appear at the bottom of a mortgagee�s transfer electronically for a mortgage sale
  • The conversion process of joint tenant owners where one or more owners have predeceased the surviving owner without having had a Will registered prior to conversion
  • Parcels to be annexed - same owners.

We also wish to remind subscribers that under "PLANET Notices" you will find "Exemptions - Conversion to Land Titles", which outlines 7 scenarios where deeds may be submitted directly to the local Land Registry Office for registration under the Registry Act , pursuant to subsection 2(5) of the Land Titles Act.
